2 Application of the terms and conditions

The acceptance of the terms and conditions of sale there implies the enforcement of these conditions. They apply to all orders placed by the customer on the site spartoo.co.uk They involve a contract between SPARTOO and the customer.

These general conditions of sale may be subject to amendment, the version that applies to the customer order is the version that is on the site on the date that the customer places their order. Changes to to these terms of sale are binding for customers purchasing after they are posted on line and cannot be applied retrospectively to transactions previous to this date.

All site users must respect the general conditions of sale.

SPARTOO also offers products that are sold and shipped by Partners: 'Partner Products'. These general conditions of sale do not apply to the price, the payment methods and the verification of payment, the type of delivery, the returns policy of merchants. Each Partner has their own terms and conditions. All customers are recommended to become familiar with these (delivery policy, returns policy, general T&Cs) when they are selecting the size and colour of the 'Partner Product': method of payment, type and delivery address.

3 Validity of our offers

The offers are for customers with a delivery address in the United Kingdom.
The items displayed on the site are available while stocks last.<
SPARTOO will notify the customer by email should an unavailable item be ordered. In the case of a debit or payment of an item that is not available, SPARTOO commits to propose a credit note or refund to customers within 15 days. The order will be cancelled automatically.

4 Presentation of products

The items available are described and presented with as much precision as possible. The customer is to read the description of each product in order to know the specific details and properties. The customer needs to inform themselves before placing their order. The choice and purchase of a product is the sole responsibility of the customer.
However, should an error or omission occur within the information, SPARTOO cannot be held responsible. All customers are invited to inform SPARTOO of any error that can be found in a product description.

5 Price of products

All prices are listed in Pounds Sterling (£GBP) inclusive of VAT for the United Kingdom. The VAT amount is indicated when the customer selects a product. We reserve the right to change prices if there is a change in the VAT rate. These changes may be passed on in the price of the items without previously informing the customer.
SPARTOO.CO.UK will not be held responsible for refunding the VAT on purchases made by customers in the Channel Islands.
SPARTOO.CO.UK reserves the right to change its prices at any time but products are invoiced at the price applicable when the order is registered.

Discount codes cannot be used on already discounted items unless stated otherwise and they are only applicable on available SPARTOO.CO.UK products. SPARTOO reserves the right to remove the promotion at any time without prior notice.

6 Ordering and Secure Payment

6.1 : Payment

The customer confirms the order as follows. By confirming an order, the customer accepts the present Terms and Conditions. A customer who wishes to purchase one or more items available on SPARTOO.CO.UK must follow this procedure to register an order. After clicking on the button "Pay Securely Now" and after verifying the contents of their order (colour, quantity, size, price, etc...), the customer confirms the purchase of one or more items with a click.
If the customer has a discount, he/she must enter in the discount code in the space provided on the payment page. First-time customers must fill in a short form which contains the following information: title, first name, surname, complete delivery address, email address, birthday, and telephone number. The customer also creates a password at this time. After having confirmed their payment, the contract for the sale of the goods will be formed.

  • Payment by Credit or Debit card

    The Customer confirms their billing address, the product, and the total price. The Customer then provides their card number, the corresponding expiry date, and the security code. The Customer finalises the payment by clicking on the button "Confirm"

  • Payment in 3 instalments

    It is possible to pay in 3 monthly instalments. One third of the order total will be debited immediately, the second third one month after your order, and the remaining amount 2 months after your order.
    This payment method is available on orders over £50 by clicking on the button "Other Payment Methods" on the payment page. The service charge is £5.
    We cannot accept: Debit only cards, cards which require systematic authorisation (Electron, Maestro, Cirrus...), Virtual cards (e-cards) and pre-paid cards.

  • American Express

    American Express is accepted on SPARTOO.CO.UK

  • Paypal

    With PayPal, your financial information is never communicated to SPARTOO.CO.UK. Paypal encrypts and protects your card number. Pay online by simply indicating your email address and password.
6.2 : Payment Default

SPARTOO.CO.UK reserves the right to refuse to honour an order placed by a consumer that has not totally or partially paid a preceding order or with whom a payment dispute is being handled.

6.3 : Payment Verifications

SPARTOO.CO.UK monitors all the orders that have been confirmed on the website, and all payments through SPARTOO will be subject to security checks from both the card provider and SPARTOO.CO.UK. This monitoring aims to protect SPARTOO.CO.UK from abusive practices operated by a fraudster and to protect our customers against unauthorised use of their payment details. Our services may contact you by email or by telephone to confirm your order information and order details: proof of address or of a debit in your name, or proof of address in the name of the person indicated for the delivery address, etc...

This order verification will be done prior to your order preparation and it may cause a delay in the preparation and despatch of your order.

6.4 : Right to cancel

You have the right to cancel the purchase of a good without having to give a reason at any time within the “cooling off period” of seven working days, beginning on the day after you receive the goods. You must notify us of your cancellation in writing or in another durable medium to our contact address. You will receive an email with a link to your pre-paid return label, which you will need to print out and attach to your parcel in order to return your purchase free of charge. All returns which have not followed this procedure will require transport to be paid for by the customer. If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us in their original condition to our contact address as soon as possible once you have cancelled the contract.

6.5: Order Details

We adhere to the supplier's contract content and will send you the details of your order as well as our general terms via e-mail. You can find the terms here at all times. The details about your recent orders can be found in your customer login.

In order to ensure secure payments, SPARTOO.CO.UK uses the secure payment service provided by CIC bank (a leading French bank). This service utilises the SSL security standard. Confidential data (16-digit card number, expiry date, security code) are encrypted and sent directly to the bank server without passing through the physical SPARTOO.CO.UK server.
When the order is validated:
The payment request is routed in real-time to the secure remote payment manager. This asks for an authorisation request from the bank card network. The remote payment manager issues an electronic certificate which is proof of the amount and the date of the transaction in compliance with articles 1316 in the French civil code.

8 Sign up / Sign in

Customers who have already made a purchase at SPARTOO.CO.UK can choose a password which allows them to proceed with new orders without filling the customer detail forms again. The Customer who has already signed up is recognised on the site as being a customer at SPARTOO.CO.UK. The SPARTOO.CO.UK customer's password is strictly confidential and personal. It must never be divulged to a third party.

If the SPARTOO.CO.UK customer has lost or has forgotten his/her password, he/she should contact SPARTOO.CO.UK customer service either by email or by telephone, and a new password will be issued within 48 hours to replace the previous one. In order to facilitate the identification of the Customer by provision of both the email address and password, the Customer expressly authorises SPARTOO.CO.UK to place a "Cookie" on the customer's computer with the sole purpose of facilitating the above-mentioned identification.

9 Delivery operated by Spartoo

Delivery times given are in reference to the order date, and presented in working days (Saturdays, Sundays and bank holidays are not taken into account for calculation of delivery time). In case of force majeur, Spartoo.co.uk can not be held responsible for any delay in delivery.

Spartoo offers different delivery services which are automatically selected depending on the products in your order.
You will find the available delivery services for your desired product(s) on the product page and on the payment page.

For any one order which contains multiple products and two different delivery services, you will receive two separate parcels upon delivery.

Items marked "Partner Product" will have different delivery services and costs. Please consult the product page to see the delivery policy for the partner product.

10 Money-back Guarantee

All items purchased at SPARTOO.CO.UK may be returned. Spartoo products can be returned for an exchange or refund (free return). Partner products can be returned for a refund only (conditions are specific to each merchant and can be found on the product page). To be accepted, returns should meet the following conditions:
- The product should not have been worn outside. It should be in new condition.
- Should be returned in the original packaging and in good condition.
- The product should be returned within 30 days of delivery of your order.
- Follow the indicated return procedure:

- Collect+: Pre-paid on Spartoo Products.

10.2 : The return procedure is as follows:

Step 1: Customer Account
Sign in to your Spartoo customer account with your email address and your password and go down to the section "my returns" to complete a return request.

Step 2 : Receive label
- If your return is pre-paid by Spartoo: you'll receive an email with a link that you can click on to print out your shipping label.
- If your return is at your charge: you will receive an email with the return address to send the product(s) back to at your charge.

Step 3 : Drop off your parcel at the selected location
Drop off your parcel at the location you chose when completing your return request if your return is pre-paid, or drop off the parcel at the location of your choice if the return is at your charge.
Please remember to keep your proof of postage receipt.

Your return will be processed within 7-10 working days.

11 Despatch and delivery problems

These are consignments which have not been delivered to the final destination for the following reasons: Undeliverable, not claimed, refused, damaged in transit, opened or consignments that are claimed as delivered by the transporter but not received by the customer.

11.1: Returned as “UNDELIVERABLE” :

Consignments returned by the transporter with the following remark: Undeliverable. Once we have received and accepted your consignment, SPARTOO.CO.UK will contact the customer in order to send the order if the product is still available or to offer a refund if the customer prefers. SPARTOO.CO.UK reserves the right to offer a refund for the order and not to re-ship it in the event several Undeliverables have been identified.

11.2 : Returns due to "NOT CLAIMED" :

Consignments which have not been claimed by the customer with Hermes within the time limits. Once we have received and accepted your consignment,SPARTOO.CO.UK will contact the customer in order to re-ship the order if the product is still available or to offer a refund if the customer prefers. SPARTOO.CO.UK reserves the right to offer a refund of the order and not re-ship it if several "NOT CLAIMED" have been identified.

11.3 : Returns due to "REFUSED" :

You have refused your consignment on delivery. Once we have received and accepted your consignment,a credit note will be put in your customer account in the 72 hours following receipt of your consignment. You can request the cancellation of your credit note and its refund directly in our CUSTOMER SERVICE section.

In the event a consignment is returned due to " UNDELIVERABLE ", "NOT CLAIMED ", or "REFUSED", SPARTOO.CO.UK cannot guarantee the reservation of items ordered and may need to offer a refund for the order if the product(s) is/are unavailable.

11.4 : "DELIVERED" by courier:

The courier claims to have delivered your consignment, either by having a proof of delivery receipt with the customer's signature, the signature of someone in the customer's household, or a neighbour, or the courier claims to have left the consignment in a safe place on the customer's property.

In the event that the consignment cannot be found, a lost parcel claim form will need to be requested from the customer service centre either by email or by telephone. All lost parcel claims forms must be sent to the following address:

Once we have received your signed and dated claims form by post, your claim will be processed and either a refund will be processed or a replacement will be shipped, depending on the customer's wishes and available stock.

In the event a consignment is returned due to " UNDELIVERABLE ", "NOT CLAIMED ", or "REFUSED", SPARTOO.CO.UK cannot guarantee the reservation of items ordered and may need to offer a refund for the order if the product(s) is/are unavailable.

12 Responsibility

For all stages, from access to the site, browsing, filling in forms,placing an order, delivering items or any other service, SPARTOO.CO.UK only has an obligation for due care. Therefore, SPARTOO.CO.UK cannot be held responsible for any inconvenience or damages arising from the use of the Internet and completely outside the diligence and precautions taken by SPARTOO.CO.UK.

In particular, SPARTOO.CO.UK cannot be held responsible for any disruption in provision of the service, or any external intrusion or presence of a computer virus. Similarly, any event which qualifies as force majeure in the legal sense by the French Court of Appeals fully exonerates SPARTOO.CO.UK from all responsibility. Customers benefit from guarantees offered by the brands listed on the site.

13 Intellectual Property

All elements on the SPARTOO.CO.UK site, visual or audio,including the underlying technology, are protected by copyright,brand and patent law. They remain the exclusive property of SPARTOO SAS All hypertext links forwarding to SPARTOO.CO.UK and using in particular framing, deep-linking, in-line linking or any other deep linking technology is strictly prohibited. In all events, any link, even authorised, must be removed when requested by SPARTOO SAS

14 Personal data protection

SPARTOO.CO.UK, in the interest of the service, reserves the right to collect personal data about site users, in particular using "Cookies" as stipulated in article 8. For this, the SPARTOO.CO.UK site is registered with CNIL under the number: 1182432. SPARTOO.CO.UK also reserves the right to use data collected on the site for commercial purposes. In all cases, and in compliance with French law n°78-17 of January 6 1978, any user or customer of the site may, at any time, competition with the commercial use of this data and also has rights to access, rectify and delete their personal data.

15 Games and Competitions

Competitions organised by SPARTOO.CO.UK are free to enter and proof of purchase is not required. They are open to all residents of the United Kingdom. Winners of competitions will be contacted by email containing their prize in the form of a code for a discount or gift voucher from SPARTOO.CO.UK. This is valid once throughout the site, excluding promotions and may not be combined with other special offers.
Excluding special promotions, money-off vouchers are valid for three months and gift vouchers for one year. If the amount of the gift voucher exceeds the value of the order placed by the Customer, the balance will be transferred to the gift voucher account. It will automatically be proposed during a future order on the "Payment" page. If the amount of the gift voucher is less than the value of the order, the Customer must add the rest by bank card. SPARTOO.CO.UK never discloses participants' names and email addresses.
By providing their email address, participants automatically agree to receive the spartoo.co.uk newsletter SPARTOO.CO.UK reserves the right to postpone or cancel the competition and cannot be held responsible for any problem which may arise during the operation. For each competition, there can only be one game winner per household (same surname, same home address, or same IP address). If an item is returned, the gift voucher won in the competition cannot be re-used.
Taking part in the competition implies full agreement with these rules. The rules may be modified at any time by the organiser, in compliance with the expressed conditions. Fraud or attempted fraud for personal gain may lead to prosecution.

16 Private Sales

The products presented in "SPARTOO.CO.UK private sales" are available to all those who meet at least two of the following conditions:
- They are a customer at SPARTOO.CO.UK having opened an account on the site with a valid email address and password
- They have received an invitation by email sent to the account address
- They have received at least one email from SPARTOO.CO.UK

17 Premium Service

Spartoo also offers a subscription service called Spartoo Premium.
The Premium Service is a subscribed service for a period of 12 months which costs £14.99 at registration. If the customer wishes to continue to enjoy the benefits of this subscription after 12 months, they may renew the subscription by ordering the service on the website for an additional 12 months for a total of £14.99.
The Premium Service advantages do not apply to partner products, displayed with the icon "Partner Product".

The benefits of the Premium Service are:

  • United Kingdom:

- 10% immediate discount on full price items (not valid during the Summer and Winter sale periods)
- 5% extra discount on sale items during the Summer and Winter sale periods (specific dates apply)
- Free express delivery on orders registered before 12 p.m.
- Payment in 3 instalments at no extra charge

  • Discount conditions:

- Purchase conditions for the 10% discount: this discount cannot be used on items already on sale and it cannot be combined with other voucher codes. It does not apply to brands excluded from our promotional offers and it does not apply to partner products. This discount is only valid on full-price items available on our website.

- Purchase conditions for the 5% discount: This discount can be used on an item which is already on sale during our bi-annual sales. It cannot be combined with other voucher codes. The discount can only be combined with the discount already indicated on the website during the sales. This discount is only valid during our bi-annual seasonal sales, and it does not apply to partner products.

18 Gift cards and money-off vouchers

Gift cards and money-off vouchers are non-refundable and have no monetary value. However, products purchased using vouchers and coupons may be returned for an exchange, or a credit note if the items are no longer in stock.
